Mr. Burt, from the Committee on Military Affairs, reported the following bill:
A BILL
To increase the efficiency of the regiments and corps of the army, and to provide for disabled and infirm officers.

Be it enacted by the Senate and House of Repre- sentatives of the United States of America in Congress assembled, That when any commissioned officer of the army shall become incapable of performing the duties of his office by reason of wounds, age, or other infirmities, he shall be retired from service on his monthly pay, with- out rations, or other allowances whatever; and the officer next in the line of promotion, efficient in physical power, shall fill the place of such retired officer with the rations and emoluments pertaining to his rank, and pay of the grade from which the junior may have been promoted: |

Provided, That any retired officer entitled to pension for wounds received in battle shall not forfeit his claim thereto. |

Sec. 2. And be it further enacted, That, to carry out the provisions of this act, the Secretary of War be, and he is hereby authorized and required, when, in his opinion the good of the service may require the procedure, to refer the case of any disqualified officer as aforesaid to an army board, which shall consist of not less than five, nor more than seven commissioned officers of rank and experience, to be detailed by the general-in-chief, or, in his absence, by the Adjutant General of the army, and the said board shall give their opinion on the merits of the case to them referred, sign and transmit the whole proceed- ings theron to the Secretary of War, to be laid before the President of the United States, for his confirmation or dis- approval and written orders. |
