Mr. J. A. Rockwell, from the Committee of Claims, reported the following bill:
A BILL
For the relief of the legal representatives of David Gardner, of Southborough, Massachusetts.
Whereas, David Gardner, late of Southborough, Massachusetts, was a gunner on board of the Bonhomme Richard, under the command of John Paul Jones, when captures were made of the Serapis, Countess of Scarborough, the Betsey, the Union, and the Charming Polly, and his name was by mistake entered on the roll of said ship as Henry Gardner:

Be it enacted by the Senate and House of Repre-
sentatives of the United States of America in Congress
assembled
, That the legal representatives of said David
Gardner shall be entitled to receive the portion of the prize

money now due, or which shall hereafter be awarded, be-
longing to a gunner on board said ship, not withstanding
the said erroneous entry of his name on said roll, and that
the same be paid to said representatives, accordingly;
they first filing with the Secretary of the Treasury a bond
with approved security, conditioned that in case it shall
hereafter appear that there was any person by the name of
Henry Gardner who served at said time on board of said
Bonhomme Richard, entitled to receive said prize money,
that the amount paid by virtue of this act shall be refunded
to the United States.
