That the President and directors of the Gerard Railroad company be, and they are hereby
authorized to survey and work through the Public Lands of the United States in the
State of Alabama a Line of rail road on the most direct and practicable route between
the Town of Gerard in Russell county and state of Alabama and the city of Mobile in
said State, and such width as may be necessary for the construction of said road not
greater than the extent of top and bottom with width hereafter specified, shall be
reserved from sales on part of the United States, and the use thereof forever vested
in the said president and directors of the Gerard Railroad company and for no other
purpose whatever. Provided: That the top and bottom widths of said road shall not
be greater than four times the depth of cutting or filling at each point of said road,
together with forty-eight feet added thereto.
Sec. 2 And be it further enacted, That if the said president and directors of the
Gerard Rail Road company shall not survey and locate said road and furnish the commissioner
of the General Land office a

map thereof through said public lands within four years from and after the date of
this act, designating the depth of cutting and filling at at least each one hundred feet of said line, and the top and bottom widths of said
road, or if the said railroad should not be completed within twenty years, or if ever
said right of way hereby granted shall cease to be occupied for a Rail road, the reservation
and grant aforesaid shall be void and of no effect so far as the said road is not
completed or is abandoned.
Sec. 3. And be it further enacted, That the said president and directors of said rail
road company shall be permitted to use for the purpose of constructing the Rail road,
such timber, stone and earth as may be necessary for such construction, on any of
the public lands in said State of Alabama along the line of said road so long as the
same may remain public lands.
