1 | BE IT ENACTED by the Senate and House of Representa- |
2 | tives of the United States of America in Congress assembled, |
3 | THATfrom and after the passage of this act, |
4 | the counties of Benton, Washington, Craw= |
5 | ford, Scott, Polk, Franklin, Johnson, Ma= |
6 | dison, and Carroll, and all that part |
7 | of the Indian country lying within the |
8 | present judicial district of Arkansas, |
9 | shall constitute a new judicial district, |
10 | to be styled, “the western district of Arkan= |
11 | sas;” and the residue of said State |
12 | shall be and remain a judicial dis= |
13 | trict, to be styled, “the eastern district |
14 | of Arkansas.” |
1 | Sec. 2. And be it further enacted, |
2 | That the judge of the district court |
3 | of Arkansas shall hold two terms of |
4 | said court at the town of VanBuren, |
5 | the county seat of Crawford County |
6 | aforesaid, on the second Monday |
7 | of May and November in each |
8 | and every year, and shall continue |
9 | in session until all the business shall |
10 | be disposed of; and he is hereby author= |
11 | ized and directed to hold such other |
12 | special sessions as may be necessary |
13 | for the despatch of the causes in |
14 | said court, at such time or times |
15 | as he may deem expedient, and |

16 | may adjourn such special sessions to |
17 | any other time previous to a stated |
18 | term. |
1 | Sec. 3. And be it further enacted, |
2 | That the district court of the United |
3 | States for the western district of Arkan= |
4 | sas hereby established, in addition to |
5 | the ordinary jurisdiction and powers |
6 | of a district court, shall, within the |
7 | limits of its ^[^respective^]^ district, have |
8 | jurisdiction of all causes, civil or crim= |
9 | inal, except appeals and writs of |
10 | error, which now are, or hereafter |
11 | may by law be made cognizable |
12 | in a circuit court, and shall proceed |
13 | therein in the same manner as a |
14 | circuit court; and an appeal or writ |
15 | of error shall be prosecuted from the |
16 | final decree or judgement of said dis= |
17 | trict court to the Supreme Court of the |
18 | United States, in the same manner |
19 | that appeals and writs of error ^[^now |
20 | are, by law^]^, from a circuit court of |
21 | the United States. |
Sec. 4. And be it further enacted, | |
That the district judge of the said district shall | |
appoint a clerk of said court hereby established. |
