BE IT ENACTED by the Senate and House of Representatives of the United States of America in Congress assembled,
THATthe Second Comptroller of the Treasury be, and he is hereby, required to adjust and settle the claim of J. W. Nye, upon principles of equity and justice, and as-certain the amount of indemnity due to him as assignee of Peter Bargy and Hugh Stewart for the loss sustained by them respectively, in the necessary performance of their contract made with the government, in eighteen hundred thirty-two, for McAdamizing a large portion of Pennsylvania avenue in the city of Washington, which loss was not occasioned by any fault or negligence on the part of said contractors, but by events beyond their control, and in consequence of the cholera and extra expenses caused thereby, and the action of the superintendent of said work in relations thereto, after deducting the allowances heretofore made in his or their favor; and that the Secretary of the Treasury be, and he is hereby, authorized and required to cause the same to be paid out of any money in the treasury not otherwise appropriated.
