BE IT ENACTED by the Senate and House of Representatives of the United States of America in Congress assembled,
THATthe act of Congress, approved January eighteenth, eighteen hundred and thirty-seven, entitled “An act to provide for the payment of horses and other property lost or destroyed in the military service of the United States,” and the acts of Congress of October fourteenth, eighteen hundred and thirty-seven, of August twenty-third, eighteen hundred and forty-two, amendatory of the aforesaid act, and the last proviso of the act of March third eighteen hundred and forty-three, be, and the same are hereby, revived, and shall continue in force for the period of five years from and after the termination of the existing war with Mexico.
Sec. 2. And be it further enacted, That the provisions of said acts shall extend to all horses ^& mules^ lost in the public service by being captured by the enemy, all horses ^& mules^ lost on board of transports or in consequence of injuries sustained on board of transports and all horses ^& mules^ employed in riding express or on other military service by order of a proper officer of the United States, where such loss was without any negligence or fault of the owner, and in all cases the officers deciding such claim

shall require satisfactory evidence by affidavits in writing of the circumstances of the loss and value of the horse ^or mule^, and shall deduct from such value any allowance or extra compensation for the risk of said horse ^or mule^ or hard service, paid under the laws relating thereto and shall allow and pay only such sum as they may deem just and reasonable in no case exceeding the sum of two hundred dollars.
