BE IT ENACTED by the Senate and House of Representatives of the United States of America
in Congress assembled,
THATthe commissioner and surveyor to be appointed on the part of the Unites States, for
the purpose of designating the boundary line and establishing upon the ground land
marks to show the limits of the United States and the Mexican republic, according
to the fifth article of the treaty between them concluded second February, one thousand
eight hundred and forty-eight, be severally appointed by the President of the United
States, by and with the advice and consent of the Senate; together with a secretary
to the said commissioner, to be appointed in the same manner, Provided That the appointment
made under this act shall terminate at the expiration of three years from the time
the person appointed shall have commenced the performance of their duties
Sec. 2. And be it further enacted, That there shall be allowed and paid to the said
commissioner a salary at the rate of three thousand dollars per annum; to the said
surveyor a salary, at the rate of three thousand dollars per annum; and to the said
secretary a salary at the rate of two thousand dollars per annum: Provided That the
salaries of the said officers shall not commence until they shall have been severally
ordered into service.–

Resolved That the Bill from Senate (No. 343) entitled “An Actto provide for carrying into effect the fifth aricle of the treaty between the United
States a& the Mexican Republic for establishing the boundary line between them. do pass with the following
Amendment
Strike out all after the enacting clause, and insert the following.
“That the commissioner and Surveyor to be appointed on the part of the United States,
for the purpose of designating the boundary line and establishing on the ground, land
marks to show the limits of the United States and the Mexican republic, according
to the fifth article of the treaty between them, concluded on the Second day of February,
one thousand eight hundred and forty-eight, shall be selected and appointed by the
President of the United States, from the corps of topographical engineers. And it
shall be lawful for the President to cause other officers of said corps, at his discretion,
to be employed to aid and assist in designating said line and establishing said land
marks. And the said Commissioner may employ a Secretary, who shall be allowed and
paid a salary at the rate of two thousand dollars per annum; Provided, That said appointment
shall terminate at the expiration of three years, from the time said commissioner
shall enter upon the performance of his duties.
“Sec. 2. And be it further enacted, That the President of the United States is hereby,
authorized to make, out of any appropriation for said service, such perdiem allowance
to officers engaged on this

duty as shall, in his judgment, be necessary to cover extra expenses.
“Sec. 3. And be it further enacted, That in order to expedite the Survey of said boundary,
it shall be lawful for the President to employ parties on different parts of the boundary
at the same time, the surveys of which parties, being approved by the commissioners
under the treaty, shall be received and treated as surveys of said boundary”.
