. . .Sec[Section] 5th That when any candidate shall disire to contest the validity of any election, or the right of any person declared duly elected to hold and exercise the office of county Recorder or Surveyor, it may be lawful for him to do so under the provisions of the Law entitled, an act to amend an act entitled an act to regulate Elections approved, February 28th 1833” in the mode therein prescribed for contesting the election Sheriff, Coroner, &c[etc.]and should any vacancy ocur in the office of county Recorder, or Surveyor, by death resignation or otherwise, such vacancy may be filled in the manner in which it is now provided by Law, that a vacancy in the office of Justice of the peace may be filled.
Sec. 6th The Judge’s of elections appointed in the differant countys in this state shall be the Judges of the elections herein provided for, which said election’s shall be held at the time & places now provided by Law for holding quadrennial elections of Justices of the peace & Constables, and at such elections the inhabitents of any county quallified to vote at a General election shall be qualified voters
Sec 7th That the county commissioners courts of the several counties be & they are hereby required to pay the said Judges & Clerks, of Elections out of the county Treasury not exceding $1.00 and also such reasonable allowance to the person conveying the returns of such election to the county seat as they may deem just, not exceding 6 cents per mile for going only
