Sec[Section]. 1st Be it enacted by the people of the State of Illinois Represented in the General Assembly: That it shall be the duty of the county commissioners courts of their respective Counties in this State at their September Term one thousand eight hundred and thirty six, and by annually
thereafter to appoint a clerk of said court, who shall give bond, and qualify in the same manner now prescribed by Law;2 any Law to the contrary notwithstanding

1Calvin Tunnel introduced HB 69, originally titled “ A Bill Making Clerks of County Commissioners’ Courts Elective,” in the House of Representatives on December 24, 1835. On December 30, the House referred the bill to the Committee
on the Judiciary. The Committee on the Judiciary reported back the bill on January
2, 1836, with an amendment, in which the House concurred. On January 4, the House
passed the bill as amended by a vote of 34 yeas to 14 nays, with Abraham Lincoln voting nay. The House amended the title so as to read “A Bill relative to the Appointment
of Clerks of County Commissioners’ Courts.” The Senate read the bill two times, but did not read it a third time.
