Sec[Section] 1 Be it enacted by the people of the state of Illinois represented by the General Assembly That it shall be the duty of the agents of the state elected or appointed under the
provisions of the act entitled “An act to p[rotect] the Canal Lands against Trespasses” approved on the fou[rth?] day of March 1837 to notify each person residing on said Lands, or who may cultivate
any part of said Lands, that unless he or she will execute bond as required by the
aforesaid act, and agree to comply with the provisions thereof as amended by this act, that he
or she must within twenty days after such notice given abandon the occupation or cultivation
of the same and each and every person who shall fail or refuse [to] abandon the occupation or possession of any Canal Lan[ds] upon being notified as aforesaid shall be liable to [pay] the sum of five dollars for every day which he or she shall continue in the occupation
or possession of such Land, after the expiration of the time limited by this act,
which sum shall be recoverable in an action of Debt or assumpsit in the name of the
state of Illinois before the Circuit Court of any County in the state or any Justices of the peace of the County in which such person may reside, and a
separate action may be maintained for e[very?] violation of the Law or an action may be maintained for the penalties in cured by
several days violation thereof provided this section shall not apply to improvements
upon Town Lots adjoining Ottoway
Sec 2 That persons who have or may execute bonds to the state under the provisions of this and the act refered to in the first section hereof shall be permitted in all cases, to remove the crop
growing upon the Land at the time the said

Land may be sold, and the same privilege shall be extended to those who remove from
the Land without having executed bond to remove the Crop growing at the time of their
removal.
Sec 3 The agents of the state appointed to protect the Canal Lands against Trespassers, are hereby authorized,
to sell the wood and timber lying upon the ground on Canal Lands, but they shall not
under any pretext sell [any?] tree standing or growing upon said [?]
[Sec] 4 All money collected by the agents of the state upon Judgments against Trespassers
upon Canal Lands [?] for the sale of Wood and timber lying on the ground, shall be paid over to the treasurer
of the Board of Canal Commissioners and constitute a part of the Canal fund
Sec 5 If any person shall without authority of Law, Quarry, and remove, from any Canal
Lands any stone, or shall remove from said Land any stone already quarried, or it any person shall use any stone taken from Canal Lands, [?] person shall be liable to pay at the rate of five dolla[rs] for every perch of such stone, to be recovered in the manner provided for recovering
pay for Timber and wood, removed from Canal Lands by the act refered to in the first section of this act.

1William Thomas introduced SB 49 in the Senate on July 15, 1837. On July 17, the Senate referred the bill to the Committee on
Canals and Canal Lands. The Committee on Canals and Canal Lands reported back the
bill on July 19 with an amendment, in which the Senate concurred. The Senate passed
the bill as amended on July 20. On July 21, the House of Representatives tabled the bill.
