Sec[Section] 1 Be it enac[te]d by the people of the State of Illinois, represented in the General Assembly, That when any will, testament[,] or codicil shall be produced to the Court of Probate for Probate of the same, and any witness attesting the will, testament[,] or codicil, shall reside without the proper county where such will, testament[,] or codicil is to be proved, but within the limits of this State, it shall be lawful for the Judge of Probate of the county where such will, testament[,] or codicil should be proved, to issue a dedimus potestation or commission annexed to such will, testament[,] or codicil in the same manner as is now provided by law, in case of non-resident witnesses, in section fourth of an act relative to wills and testaments, approved January 23d 1829, to take the evidence of such witness and satisfactory proof being made thereupon, to admit the said will to probate in like manner as if such oath or affirmation had been made in the Court of Probate from whence such commission issued. This law to take effect from and after its passage.
