sec[section] 1 Be it enacted by the people of the State of Illinois, represented in the General Assembly, That the Board of Commissioners of the Illinois and Michigan Canal, be, and they are hereby invested with discrestionary power to ^pay^ over to James Brooks, Canal Contractor, out of the Canal fund, any sum in the exercise of their best judgment,
not exceeding three thousand dollars in whole or in part indemnification of the said
Brooks for the loss of his property necessary to be used by him in the prosecution of said
contract, occasioned by the lawless and violent proceedings of a late mob on said
Canal.
Sec 2 The Commissioner of Public works for the fourth judicial Circuit, is hereby authorized and required to pay over to Stewart & Co., late contractors for the delivery of the rock for the works at the Grand rapids
of the Wabash river, one half the amount of the retained per centage, retained on the said contract.2

1Joseph Naper introduced HB 343 in the House of Representatives on February 20, 1839. The House referred the bill to the Committee on Canals and
Canal Lands. The Committee on Canals and Canal Lands reported back the bill on February
25 with amendments. The House amended the amendments by adding another section.
The House adopted the amendments as amended. The House passed the bill as amended
on February 26. On February 28, the Senate amended the bill by striking out the second section. The Senate rejected the bill
as amended by a vote of 11 yeas to 22 nays. The Senate and House incorporated provisions
of the bill into Misc SB 6.
