Sec[Section]. 1. Be it enacted by the people of the State of Illinois represented in the General Assembly, That Judgments rendered by any Court of record in this State shall be considered as, or taken to be, a lein, or incumbrance upon any real estate, out of the County in which such judgment was, or shall be rendered, unless, a certified copy of such judgment under the Seal of the Court, shall be first recorded in the recorders office for the County in which the land shall be situated, upon which it is intended to create such lien or incumbrance, and the commencement of such lein or incumbrance, shall be dated, and take effect from the time of recording of such certified copy of judgment and not before.

1Ebenezer Peck introduced SB 24 in the Senate on December 17, 1838. The Senate passed the bill on December 22. On December 26, the House of Representatives referred the bill to the Committee on the Judiciary. The Committee on the Judiciary reported back the bill on December 31 with a substitute, in which the House concurred. The House subsequently tabled the bill.
