Sec[Section] 1 Be it Enacted by the People of the state of Illinois represented in the General Assembly That so much of the fourth section of the act entitled an act to amend the several
acts in relation to common schools as requires two thirds of the votes given in any
Township to be in favor of becoming incorporated is hereby repealed and hereafter
it shall only be necessary for a majority of all the votes given to be in favor of
becoming incorporated, to entitle the citizens of any Township to the benefits of
the above recited act This act to take effect and be in force from and after its passage2

1Franklin Witt introduced SB 59 in the Senate on January 3, 1839. On January 17, the Senate tabled the bill. On January 29, the
Senate took up the bill and passed it by a vote of 21 yeas to 18 nays. On February
4, the House of Representatives referred the bill to the Committee on Education. The Committee on Education reported
back the bill on February 19 with amendments, in which the House concurred. On February
23, the House recommitted the bill to the Committee on Education, with instructions
to strike out the earlier amendments and insert new amendments related to the fund
commissioners of the School Fund. The Committee on Education reported back the bill
on February 25 with amendments, in which the House concurred. The House further amended
the bill by striking out the last sentence in the first section. The House passed
the bill as amended. On March 2, the Senate refused to concur with the House amendments,
sending the bill and proposed amendments back to the House. On the same day, the
House tabled the bill and proposed amendments.
