Sec.[Section] 1. Be it enacted by the people of the state of Illinois represented in the General Assembly, That the joint Agent appointed or who who shall hereafter be appointed by Thomas S. Heinde and William McDowell original proprietors, of the town of Mt Carmel or their heirs, be and the same is hereby authorized and empowered to sell and convey a certain reserve of land estimated to be about fifty acres and bounded by fourth street running to the mouth of White River on the north by the Wabash River reserve on the East, and bounded on the west by the canal reserve.
Sec 2. Before offering the said land for sale the said agent shall cause the same to be laid off into lots, streets[,] and Alleys, under the direction of the board of Trustees of the Mount Carmel Academy and shall be called the Academy addition to the town of Mount Carmel, and a plat thereof shall be recorded according to law.
Sec 3. That the sale of said lots, shall be made at such time and manner and upon such terms as shall be prescribed by the board of Trustees of the Academy aforesaid.
Sec 4. That the said agent aforesaid before he shall proceed to sell said lots, shall give bond and security to the President and Board of Directors or Trustees of said Academy conditioned for the faithful execution of the Trustees, and performance

of the duties by this act enjoined upon said Agent, and on the receipt of any money or monies for the sale of lots aforesaid he shall pay the same over to the Treasurer, or to the order of the board of directors or Trustees of said Academy, and if sale sales or any of them shall be made on a credit the said Agent shall take notes for the same from the purchaser or purchasers, which shall be payable to the President and directors or board of Trustees of said Academy.
Sec 5. All moneys arising from the sale of the lots aforesaid shall be appied on ^or^ the interest thereof to the building of a suitable edifice to be called the mount carmel Academy.
Sec. 6. That the said Agent aforesaid said on payment being made of the purchase money for the sale of any of said lots he shall convey the same to the purchaser or purchasers by and in fee simple, the legal title of the said Thomas S. Hinde and William McDowell, the original proprietors and donors of said land.
Sec. 7 This act to be in force from and after its pas^s^age.

1On January 8, 1840, Joseph G. Bowman in the House of Representatives presented the petition of citizens of Mount Carmel, requesting permission to sell certain lands, the proceeds of which to be applied to the establishment of an academy. The House referred the petition to a select committee. In response to this petition, Bowman of the aforesaid select committee introduced HB 127 in the House on January 14. The House passed the bill on January 27. The House reported the bill’s passage to the Senate, but the latter took no action.
