Whereas doubts have arisen in the construction of the act Entitled an act to provide
for the Probate of Wills in certain cases, Therefore
Sec[Section] 1 Be it Enacted by the People of the State of Illinois Represented in the General Assembly. That the said act shall extend to all persons who since they have become witnesses
to any will[,] Testament[,] or codicil shall have or may hereafter become Probate Justices of the Peace or shall
have been or may hereafter be authorised by Law, to grant Probate of Wills or Testament
Sec 2 Appeals shall be allowed in cases arrising under this act, and the act to which this is an amendment, from the decision or order
of the Circuit Court, to any person who may consider himself or herself agrieved, by such decision or orders, as aforesaid, to the Supreme Court and the like proceedings shall be had in such cases as in other appeals from the
Circuit to the Supreme Court

1John Murray introduced SB 60 in the Senate on January 2, 1840. On January 3, the Senate referred the bill to the Committee
on the Judiciary. The Committee on the Judiciary reported back the bill on January
13 with amendments, in which the Senate concurred. The Senate passed the bill as
amended on January 18. On January 31, the House of Representatives ordered the bill to a third reading, but did not read it a third time.
