Sec[Section] 1 Be it Enacted by the People of the State of Illinois Represented in the General Assembly
That in all cases where any Guardian, Administrator[,] or next friend, has or may Execute any note to Enable any minor heirs, devisees[,] or assignees to avail themselves of the benefit of the relief afforded by the first
section of the act Entitled “an act for the relief of purchasers of Canal lots and
lands, and for other purposes” approved March 2, 1839 such Guardian [,] Administrator[,] or next friend shall not be ^held^ liable in his own right for the amount of such note or notes given by him any farther
than he may have property or assets in his hands belonging to the person or persons
for whom he signs
Sec 2 That minors[,] heirs[,] and devisees shall have until the first day of June next to avail themselves of the
benefit of the first section of the act to which this an amendment

1James H. Woodworth introduced SB 114 in the Senate on January 18, 1840. The Senate referred the bill to the Committee on Canals and
Canal Lands. The Committee on Canals and Canal Lands reported back the bill on January
21 without amendment, recommending its passage. The Senate passed the bill on January
25. On January 25, the House of Representatives referred the bill to a select committee of nine that included Abraham Lincoln. The select committee reported back the bill on January 27 with an amendment. On
January 28, the House amended the first section of the committee’s report by adding
a proviso, but then rejected the first section by a vote of 34 yeas to 39 nays, with
Lincoln voting yea. The House then concurred with the second section of the committee’s
report. The House later refused to re-consider the vote on the first section by a
vote of 41 yeas to 42 nays, with Lincoln voting yea. The House passed the bill as
amended on January 30. The House informed the Senate of the bill’s passage and amendment,
but the latter took no action on the House amendments.
