Sec.[Section] 1 Be it enacted by the People of the State of Illinois represented in the General Assembly. That hereafter the clerks of the circuit courts, Clerks of the County commissioners Courts, Probate Justices of the peace and County Recorders, shall not only keep their offices at their respective county seats but also reside at, or within one mile of their Court Houses or usual place of holding courts; so that they can give their daily attention to the duties of their office.
And if any clerk, Probate Justice of the Peace, or Recorder shall neglect to comply with the provisions of this act, their offices shall be considered vacated and shall again be filled as in case of other vacancies. Provided this law shall not affect the officers in any county ^Except Jersey^ wherein the permanent seat of Justice may not be located until six months shall elapse after the location of the same
Sec.[Section] 2 This act to take effect from and after the first day of March next.

1John H. Murphy introduced HB 37 in the House of Representatives on December 19, 1839. The House referred the bill and proposed amendments to the Committee on the Judiciary. The Committee on the Judiciary reported back the bill on December 26 with amendments, in which the House concurred. On January 2, 1840, representatives offered amendments, and the House tabled the bill and proposed amendments until July 4.
