Sec[Section] 1 Be it enacted by the people of the State of Illinois represented in the General Assembly That the members of the Montgomery Lyceum, and all persons who shall hereafter become associated with them, are hereby constituted
a body corporate and politic by the name of the Montgomery Lyceum, and by that name shall have power to contract and be contracted with, sue and be,
sued, implead and be impleaded answer and be answered unto in all courts having competent
jurisdiction and shall be vested with all the powers and privelages necessary to fulfil the objects of their Incorporation.
Sec 2 The object of said corporation shall be the promotion of Moral and intelectual improvement by the instruction of its members in literature, science[,] and the arts, and the general dissemination of Knowledge, and for those purposes
shall have power to establish and maintain a library, reading room cabinet, chemical
and philosophical apparatus[,] and such other means as may be nec[ess]ary for the furtherance of its objects as aforesaid.
Sec. 3. Said corporation, shall have power to elect such officers, appoint such committees[,] and adopt such by Laws as may be necessary for its government, the management of
its concerns[,] and the fulfilment of its objects to make have and use a common seal, and the same
to alter and amend renew at pleasure

to erect a building in the town of Hillsboro for the accommodation of said Lyceum, and for that purpose to obtain by purchase or otherwise and hold so much land in
said town as may be necessary for said building provided the same shall not exceed one acre,
to take, hold[,] and convey all such real and personal property as may be received by donation or
bequest, and also to take hold and convey all such books, papers[,] cabinet apparatus[,] and furniture as may be necessary for attaining the objects, and carrying into effect
the purposes of the said corporationSec 4. The several officers of the said Lyceum, at the time of the passage of this act shall continue to hold their respective offices
as officers of the corporation hereby created, until the next annual election unless in case of a vacancy previously
occurring by death[,] resignation[,] or otherwise and all real or personal property or funds in securities now held by
the said officers or either or any other person or persons in trust for the said Lyceum shall by virtue of this act vest in and become the property of and may be sued for
and recovered in the name of the corporation hereby created.
Sec 5 Said corporation shall have power to raise funds by subscription in such m

manner as may be provided in its by laws now adopted or hereafter to be adopted,
and all its estate property and funds shall be devoted soley to the general purposes and objects as prescribed in the second section of this act,
provided capital stock of said company shall not exceed ten thousand dollars.
Sec 6. said corporation may require of its treasurer sufficient bonds and satisfactory securities for the
faithful performance of his duties.

1On December 19, 1839, Josiah Fisk in the House of Representatives presented the petition of the Montgomery Lyceum, requesting incorporation. The House referred the petition to a select committee.
In response to this petition, Fisk of the aforesaid select committee introduced HB
68 in the House on December 28. The House passed the bill on January 27, 1840. The
House informed the Senate of the bill’s passage, but the latter took no action.
