On motion of Mr. R. W. Thompson.
Resolved, That the parties to the contested election from the Sixth Congressional
District of the State of New York, be and they hereby are, authorized to take the
testimony of such witnesses as either of them may require by by depositions, in conformity to the laws of the State of New York, in force at the
time of taking such testimony, on the subject of contested elections in that State:
Provided, that the parties may, by agreement under their hands, regulate the mode of giving
notice, and other matters of form, at their discretion; but if no such agreement shall
be made, then each party shall give to the other such notice of the time and place
of taking such depositions as are prescribed in the aforesaid laws of New York: Provided, also, that when such depositions are taken, they shall, together with the agreements
or notices aforesaid, be sealed up by the officer taking the same, and directed to
the Speaker of this House.
