An Act to amend an act entitled “an Act concerning jails and jailers” approved Jany[January] 26th ^ 1827^

Be it enacted by the People of the State of Illinois represented in the General assembly. That hereafter the common jails in each and every County in this state shall be under the superintendence and controul of the County Commissioners of the respective Counties.2
Sec[Section] 2d The said County Commissioners shall have power and it shall be their duty in each and every County in this state in which is erected a jail with ^a^ rooms or rooms which may be occupied by a family at their March Term in each and every year let out and rent said rooms to any person or persons for the term of one year upon such terms and conditions as to them shall seem most proper.
Sec 3d The said County Commissioners shall give to the person or persons renting said jail a lease of the same for one year to expire at the next March Term of their Court conditioned for the payment of rent by the lessee to the Treasurer of the County quarterly, provided that nothing in this act contained shall be construed to affect or impair the right of the sheriff of such County to appoint a jailer under

him as provided in the second section3 of the act to which this is an amendment and provided also that the Lessee of said jailer shall be appointed by the sheriff and receive the same compensation now provided by Law for the keeping of prisoners
Sec 4th All acts and parts of acts coming within the intent[,] purview[,] and meaning of this act and hereby repealed
This act to be in force and take effect from and after the 1st of March next

1Solomon Parsons introduced HB 224 in the House of Representatives on February 10, 1841. On February 12, the House referred the bill to the Committee on the Judiciary. The Committee on the Judiciary reported back the bill on February 15, recommending its rejection. The House refused to engross the bill.
