An ACT for the benefit of the persons therein named.

Duty of canal com’rs.
Sec.[Section] 1. Be it enacted by the People of the State of Illinois, I represented in the General Assembly, That the board of commissioners of the Illinois and Michigan canal, be, and they are hereby authorized to settle with James W. Eagan, Joseph Otis Glover, and James W. Roberts, for work done by them on sections number one hundred and sixty-three, (163) and one hundred and sixty-four, (164) of said canal; and to pay to them or their legal representatives, the full value of all such work, including the per centage, if any, retained by said commissioners in pursuance of the laws of this State relating to the construction of said canal.
Suit at plaintiff’s cost.
Sec. 2. That James W. Eagan, Joseph Otis Glover, and James W. Roberts, shall dismiss the suit commenced by them in the La Salle circuit court, against the board of commissioners of the Illinois and Michigan canal, and shall pay all costs by the State expended in said suit.
Obstructions to be removed
Sec. 3. The commissioners of the Illinois and Michigan canal are hereby authorized to cause any obstructions to be removed from any of the canal lands, whether said obstructions be by dam or otherwise, if, in their opinion the interest of the State require the same to be done.2

1William Stadden introduced SB 124 in the Senate on January 18, 1841. On January 19, the Senate referred the bill to the Committee on Canals and Canal Lands. The Committee on Canals and Canal Lands reported back the bill on February 24 with an amendment, in which the Senate concurred. On February 25, the Senate amended the bill by adding an additional section. The Senate passed the bill as amended. The House of Representatives concurred on February 27. On February 27, the Council of Revision approved the bill and the act became law.
