Sec.[Section] 1. Be it enacted by the people of the state of Illinois represented in the General assembly That hereafter each grand and petit Juror shall be entitled to receive a sum not exceeding one dollar and fifty cents for each day they may serve in the circuit Court of their respective Counties.
Sec. 2. The County Commissioners Courts, at their March term, or at some term thereafter previous to the September term shall cause an order to be made on their records fixing the amount which grand and Petit jurors shall receive per day not to exceed the sum aforesaid, and said sum when fixed shall not be altered until the March term thereafter. Provided however that until an order is made by the County Commissioners Courts as aforesaid grand and Petit jurors shall receive the sum of seventy five cents for each day they may serve.
Sec. 3. The Clerk of the circuit Courts of the respective Counties in this state, shall on application made by any juror verified by the oath or afformation of such juror, furnish such juror free of charge, a certificate of the number of days such juror has attended at said Court, and also the term of the court at which the service was rendered, and hereafter such certificates shall be received in payment of debts or taxes2 due the County, according to the sum specified upon their face.

Sec. 4. Any juror who has served heretofore as such and has received no certificate of his services shall be entitled to receive one by conforming to the provisions of the foregoing section, and all certificates theretofore granted to jurors shall be receivable for debts due the County.
Sec. 5. Whenever the county commissioners court of any county in this state shall made an order fixing the sum which each juror shall receive per day for his services, it shall be the duty of the clerk of said court within one week thereafter to furnish the Treasurer and Collector of the county, and the Clerk of the circuit court of said county with a copy of said order, and for neglect of this duty he shall be liable to be sued in the name of the County Commissioners of the county, and shall pay a sum not exceeding fifty dollars.
Sec. 6. Jury fees and docket fees shall hereafter be taxed and collected as other costs, and it shall be the duty of the County Treasurer to demand of the sheriff and clerk of the circuit courts, at least twice in each year, all jury fees and docket fees which they may have received and in case they fail to pay over every jury fee, or docket fee which they have collected, it shall be his duty to bring suit forthwith in the name of the County commissioners fo the county, against such delinquent sheriff or Clerk 3
Sec. 7. The clerks of the circuit courts shall keep a list of all the certificates granted by them to jurors, and

it shall be their duty within thirty days after the close of each term of the court to furnish a copy of the list, and also a list of all the cases on which jury fees are due to the county on judgements rendered at the previous term of the court to the county Treasurer.
Sec. 8. This act to take effect from its passage and all parts of acts coming within the purview of this act are hereby repealed.4

1David J. Blackman introduced HB 96 in the House of Representatives on January 9, 1841. The House referred the bill to the Committee on the Judiciary. The Committee on the Judiciary reported back the bill on January 30 with an amendment as a substitute. The House amended the substitute by adding the words “or taxes” after the word “debts” in the third section. The House also amended the sixth section by adding the words “and docket fees” after the words “jury fees” or “jury fee” wherever they occurred in the section. On February 11, the House passed the bill as amended by a vote of 77 yeas to 5 nays, with Abraham Lincoln voting yea. On February 13, Senate indefinitely postponed further consideration by a vote of 19 yeas to 18 nays.
