An ACT to prevent any assessment of damages in consequence of the location of railroads where the land has not been actually used for the construction of said railroads.

Part of act repealed.
Sec. 1. Be it enacted by the People of the State of Illinois, represented in the General Assembly, That so much of any act or acts, heretofore passed by the General Assembly of this State, as authorizes any circuit court, or any justice of the peace and appraisers to inquire into and assess damages in favor of individuals or corporations, in consequence of the survey or location of any railroad or other road over the land of individuals or corporations, except where such land has actually been used, and the railroad or other roads constructed, be, and the same is hereby repealed. That the act, entitled “An act to amend the law in relation to change of venue,” approved, February first, one thousand eight hundred and forty, be, and the same is hereby repealed.2 This act to take effect from and after its passage.

1William Wilson introduced HB 98 to the House of Representatives on January 11, 1841, and the House referred it to the Committee on Internal Improvements. The committee reported back on February 4 and recommended several amendments, to which the House concurred and passed an additional amendment repealing the “change of venue” act. The House passed the bill on February 11. The next day, the Senate passed the bill on February 18. The Council of Revision approved the bill on February 23 and the act became law.
