The County Virgil1 shall shall be created upon the followling conditions to Wit; Ther shall be an Election held On the fourth Monday of March next at all the places of voting for Justices of Peaces and constables in the lands those parts of the Counteis of Sangamon and Macoupin proposed by this act to be set off into the County of Virgil said Election shall be opened and Conducted by the present Judges of Election s in said districts ten days notice of said Election shall be given by the Judges of Election in their respective districts by putting up written advertisements in ^at^ least two of the most public places in said districts said Elections shall be conducted in all respects as other Elections are conducted under the laws of this state and said Judges shall make returns of said Election within five day after said Election to the House of George Deatherages directed to Mathew Cyrus, Waller W Rice, and George Rigg, three acting Justices of the Peace in the bounds of said County of Virgil said Justices shall meet at said Deatherages within seven days of said Election and proceed to open and Examine the returns of said Elections of ^and^ if it shall appear that a majority of the Votes Given in that part of Sangamon county proposed to be set off and made a part of the the county Virgil, ^shall ^be^ in favor of the creation of sd[said] county^ and if a majority of the votes Given in that part of the county of Macoupin proposed to be set off into the county of Virgil shall be in favor

of the Creation of said County then and in that case the County of Virgil shall be created and Organized as provided for in the forgoing act but if there shall ^be^ a majority against the creation of said county in either of bounds above named then said county shall not be so created2 if said county shall be created as provided for in this act the said Justices shall cause four abstracts of the Votes Given to be made out one of which shall be sent to Each of the Clerks of the county commissioners courts of Sangamon, Morgan, and Macoupin Counties s which shall be recorded and filed by said clerks and one copy shall be sent to the secretary of state to be by him filed and preserved
If there shall be no Judges of Election in said districts or if said Judges shall fale or refuse to act the voters shall appoint Judges for the [...?]Election and if the Judges shall [...?] ^refuse^ or neglect to Give notice as provided for in the foregoing section it shall not opperate against the legality of said Election

2Although the territory for Virgil County came from Macoupin, Morgan, and Sangamon counties, only voters in Macoupin and Sangamon counties would have had an opportunity to vote for or against the creation of the county, according to the terms of this amendment.
