Sec.[Section] 1st Be it enacted by the people of the State of Illinois Represented in the General Assembly,2 That whenever an Administrator or Administrators shall be appointed and quallified on the estate of Benjamin A Clark deceased Late Sheriff of Wayne County such Administrator or Administrators or any one of them is hereby authorized and empowered to collect any and all taxes that may be due on the books of said Sheriff for the years 1831, 1832[,] 1833[,] and 1834, by distress and sale of personal or real estate, Subject to the provisions of the Laws now in force in this State relative to the collection of the revenue, in the same manner as sheriffs may now Lawfully collect taxes and enforce the payment thereof: and the same when collected shall be assets in the hands of such Administrator or Administrators.3

1Charles Dunn introduced HB 58, originally titled “ A Bill to Appoint Commissioners out of the State,” in the House of Representatives on December 23, 1835. The House referred the bill to the Committee of the Whole and made it the order of the day for December 24. On January 1, 1836, the Committee of the Whole reported back the bill with an amendment that struck out all after the enacting clause. The House concurred in the amendment and referred the bill to a select committee. The select committee reported back the bill on January 12 with an amendment, in which the House concurred. On January 13, the House passed the bill as amended, changing its title to “A Bill for the Benefit of the Legal Representatives of Benjamin A. Clark, Deceased.” The Senate took no action.

2On January 1, 1836, the House of Representatives amended the bill by striking out all after the enacting clause. On January 12, the House approved an amendment that pertained to the legal representatives of Benjamin A. Clark.

3On February 20, 1836, James N. Clark became the administrator of the estate of Benjamin A. Clark. In 1837, the General Assembly passed an act on his behalf very similar to this bill.
