Sec.[Section] 1. Be it enacted by the people of the State of Illinois Represented in the General assembly, That an Auditor of Public accounts shall be elected at the present Session of the General assembly, To fill a vacancy which has happened in said office since the Last election of Auditor, any Law to the contrary notwithstanding.2 And the auditor who may be elected under the provisions of this act, shall be commissioned by the Governor and hold his office until the end of the next regular Session of the General Assembly of this State, and take and Subscribe an oath of office according to Law.

1John D. Hughes introduced HB 98 in the House of Representatives on December 31, 1835. The House referred the bill to the Committee on the Judiciary. The Committee on the Judiciary reported back the bill on January 2, 1836, with an amendment, in which the House concurred. The House passed the bill as amended on January 4. The Senate took no action.

2In 1831, the General Assembly passed an act making the office of auditor of public accounts elective by the Legislature. The first election was to be held on the first Monday in December 1834, and every four years thereafter. On January 1, 1835, James T. B. Stapp became the first elected auditor of public accounts. He resigned on November 15, 1835. On November 16, Governor Joseph Duncan appointed Levi Davis to fill the vacancy.
