An Act to subject lands held by certificate to be sold under execution
Be it enacted by the people of the State of Illinois, represented in the general Assembly, That in all cases where the land of any individual, held by certificate of purchase of any commissioner or other officer of this State, authorized by law to sell lands, ^has been or^ shall be sold under execution or decree of any court, and the judgment debtor shall fail or refuse to surrender such certificate of purchase to the Sheriff or other officer or person making such sale, to be transferred to the purchaser, it shall be lawful for such purchaser, on filing with the commissioner, or other officer, who sold such lands originally, a memorandum of such sale, under execution, signed by the Sheriff &c.[et cetera], to demand, and receive from him a duplicate of such certificate of purchase, and on presenting the same to the sheriff or other person who sold the same under execution or decree, it shall be his duty to transfer the same to such purchaser; which transfer shall vest all the right of the judgment debtor, in and to said lands, in the purchaser; and patents shall be granted by the State, or the proper officer thereof, to such assignee in like manner as if such assignment had been made by the judgment debtor himself. Provided Provided, that nothing herein contained shall affect any right of redemption secured by law; but on such law being redeemed, the purchaser shall convey the same to the defendant, in the execution, or judgment creditor so redeeming. Provided also, that nothing herein contained shall be construed to prejudice the just claims of any other person to the said land.
