The select Committee to whom was referred, A Bill for “an act in addition to the several acts for the Support of Common Schools.” Amend the Same by inserting after the enacting Clause the following:
Sec[Section] 1 That all fines arising from offences cognizable before Justices of the peace, where such offences shall be prosecuted and determined in Justices Courts, and where no appeal shall be taken by the defendant, shall be appropriated for the support of Common schools in the respective Townships where the offence may have been Committed.
Sec 2 It shall be the duty of Justices of the peace to proceed in all cases contemplated in this act as is provided by law, Provided that in all cases where no appeal is taken within the time prescribed by law, that execution shall issue in behalf of the trustees of the school Fund in the Township where the offence may have been committed, Provided also that nothing in this act shall be so construed as to prevent the defendant from paying the fine and costs to the Justice.
Sec 3. When any Constable shall have Collected any money by virtue of any execution issued in accordance of this act, it shall be his duty to pay the same to the Justice who issued said execution, whose duty it shall be to pay over the same to the trustees of the school fund in

the Township, in which the offence was committed, and the said Trustees are hereby authorized to receive and receipt for the same, and the same to appropriate to the use of common schools, in the same manner that the proceeds of Township school funds are appropriated by law.
Sec 4. All acts and parts of acts coming within the purview of this act are hereby repealed. This act to take effect from and after the first day of may A.D. 1837.2

The House referred the bill to a select committee, which reported back the bill with an amendment as a substitute on February 23. The House approved the amendment. On February 24, pending several proposed amendments, the House tabled the bill.
