Sec[Section] 1 Be it enacted by the people of the State of Illinois represented in the General assembly, That the President and Trustees of the corporation of the town of Carrollton in the county of Greene chosen under, and acting in conformity to a law entitled “an act to incorporate such
Towns as may wish to be incorporated” approved on the twelfth day of February eighteen
hundred and thirty one, shall not, after the passage of this act have power to levy
and collect, anually a higher tax on the real estate in said Town than twenty five cents on each hundred dollars assessment valuation thereof Neither
shall they have power to levy and collect a Tax from any real estate within the limits
of Said Town unless the same shall have been laid out into town lots2
Sec 2 If an individual shall consider him or herself injured by, or that his or her rights
and privileges which are guaranteed to him or her by the constitutions and laws of
the United States, and of this State are violated through the execution and operation of any ordinance or law made by
the corporate authorities of the Said Town, and such violation shall be clearly established, and finally determined by a Jury
in a suit instituted in the circuit court for Greene county Then in each and every such case the President and Trustees of Said Town Shall pay to each and every individual who may sue for the infraction of their rights,
the sum of twenty dollars and double the value of the damage done any and every such
individual, together with all costs which may

accrue, The costs shall be paid to the proper officers
Sec 3 If the President and Trustees of said Town Shall fail or refuse, within ten days after the rendition of a Judgement as authorized by this act, to pay the sum of twenty dollars and the damages and costs
as directed by this, then in any such case the corporate powers of the President and
Trustees shall cease until they shall liquidate and pay the Same
Sec 4 If the Said Presidents and Trustees shall fail or neglect to caus to be kept in repair all Roads and public highways within the limits of the corporate
bounds of said Town they shall be liable to be indicted and proceeded against as supervisors of highways

1On December 30, 1836, John Allen in the Senate introduced the petition of citizens of the town of Carrollton, requesting repeal of the general municipal incorporation act of 1831. The Senate
referred the petition to a select committee. Responding to this petition, Allen of
the select committee introduced SB 16 in the Senate on February 3, 1837. The Senate
passed the bill on February 9. On February 27, the House of Representatives referred the bill to a select committee, which took no further action.

2Section five of the municipal incorporation act of 1831 allowed presidents and trustees
to levy and collect annually a tax on all real estate not exceeding fifty cents on
every hundred dollars of assessment valuation thereof.
