AN ACT to authorize James T. Gifford andSamuel J. Kimball to build a dam across Fox river.
1Mill-dam across Fox river.
Proviso.
Sec.[Section] 1. Be it enacted by the People of the State of Illinois, represented in the General Assembly, That James T. Gifford and Samuel J. Kimball, their heirs and assigns, be, and they are hereby, authorized to construct and build a mill-dam across Fox River, at the town of Elgin, in the county of Kane, between the lands held by them, to the height of six feet above low-water mark: Provided, Said grant shall not be construed so as to prevent the State from improving said Fox river at that place, by dams, locks, or in any other way, at any time hereafter, for the
purpose of slack-water navigation, or otherwise. This act shall take effect from
and after its passage.

1Joseph W. Churchill presented a petition from citizens of Kane County to the House of Representatives on January 14, 1839, requesting that James T. Gifford and Samuel J. Kimball be allowed to build a bridge across the Fox River and the house referred it to a select committee. On January 19, Churchill introduced
HB 167. The House passed the bill on January 23. The Senate referred the bill to a select committee on February 5. The Senate passed the bill
on February 12. The Council of Revision approved the bill on February 15 and the act became law.
