Sec.[Section] 1. Be it enacted by the People of the State of Illinois represented in the General Assembly That Benjamin Bruce and A. K. Boutwell of Gallatin County and Robert Wilson of Hamilton County, be and they are hereby appointed Commissioners to view[,] mark[,] and locate a road Commencing at McKenzie[]s place in Hamilton County running by way of Bartlett Garnett[]s in said County thence running by way of Benjamin Bruce[]s and A. K. Boutwell[]s, to Shawneetown in Gallatin County
Sec. 2. Said Commissioners or a majority of them shall meet at the house of Robert Wilson in Hamilton County on the first Monday in April next or as soon thereafter as practicable and after being first sworn by some Justice of the Peace of said County faithfully to discharge the duties required of them by this act shall proceed to view[,] mark[,] and locate said road on the most eligible and advantageous ground; taking into consideration the public convenience[,] utility[,] and economy so as to make the same a permanent road.
Sec. 3. as soon as practicable after said road is located, the said commissioners or a majority of them; shall make a report thereof under their hands and seals, and return the same to the Clerks of the Commissioners Courts of Hamilton and Gallatin Counties which report shall be filed and preserved in their offices, and the said County Commissioners Courts shall cause so much of said road as lies in their respective Counties to be opened four Poles wide and the same is hereby declared to be a state road
Sec. 4. The County Commissioners shall allow said Commissioners such Compensation for their services as to them shall appear reasonable

1On January 24, 1839, Tarlton Dunn in the House of Representatives presented the petition of citizens of Gallatin County, requesting the location of a state road in said County. The House referred the petition to a select committee. In response to this petition, Dunn of the aforesaid select committee introduced HB 256 in the House on February 4. The House passed the bill on February 13. On February 28, the Senate refused to read the bill a third time.
