AN ACT for the amending the act, entitled “An act to provide for the election of
justices of the peace and constables, approved 30th December, 1826.”
1Justices to issue executions when not satisfied, on deceased justices’ dockets.
Sec.[Section] 1. Be it enacted by the People of the State of Illinois, represented in the General Assembly, That justices of the peace, to whom the dockets and papers of other justices have
been, or may hereafter be, transferred or delivered, because of the resignation, removal,
death, or expiration of the term of service of the justice whose dockets and papers
have been or may be transferred as aforesaid, shall be authorized to issue executions upon all judgments remaining unsatisfied
upon such dockets, and proceed in the collection thereof as though such judgments
had been rendered by the justice having possession of such docket and papers.

1William Thomas introduced the bill, originally titled “A Bill to Provide for Issuing Executions
in Certain Cases,” in the Senate on December 18, 1838. The Senate passed the bill on January 2, 1839, amending the
title so as to read “A Bill Further Amending an Act Entitled ‘An Act to Provide for
the Election of Justices of the Peace and Constables,’ Approved December 30, 1826.”
The House of Representatives concurred on January 7. On January 12, the Council of Revision approved the bill and the act became law.
