Whereas, the said Russell Emigrated to the State of Illinois and located himself in the county of Johnson in the year 1827, and continued to reside there in the capacity of a single man until the year 1835, during which time he accumulated property [both] real and personal, and the said Russell, as is believed, became [?] himself suddenly, leaving all his effects without any heir or agent known whatever, and yet remains absent and is presumed to be dead; Therefore:
Sec[Section] 1 Be it enacted by the people of the State of Illinois, represented in the General Assembly, That the Probate Justice of the Peace of the county of Johnson, is hereby authorized to appoint a suitable Administrator, whose duty it shall be to proceed to sell the property of the said Russell in the manner prescribed by law as in other cases of administration
Sec 2 The administrator appointed under the provisions of this act, shall give bond [as in] all cases of administration, and make settlement [?] the Court of Probate; and the money arising from such sale, after the payment [?] and expenses, shall be loaned at 10 per cent. for the space of five years, and if no legal representative applies duly authorized to receive said estate, it shall be added to the School fund of the County of Johnson, and the interest only to be used as in other cases of School funds; provided that this act shall not be construed to prevent the legal heirs of the said Russell from drawing the principal of said estate, after it may be so added to said school fund.
This act to be in force from its passage.

1James Copeland introduced HB 92 in the House of Representatives on December 31, 1838. The House passed the bill on January 4, 1839. On February 7, the Senate rejected the bill by a vote of 10 yeas to 23 nays.
