Sec[Section] 1 Be it enacted by the People of the state of Illinois represented in the General Assembly, That the County Commissioners Courts, of each County in this state, at their March term annually, shall Enter upon the records of their Court An Order requiring that each able bodied man, between the age of twenty-one, and Fifty years, shall labour one day on some public road within the County where he may reside And it shall be the further duty of said County Commissioners Court at their said March term to assess a such a per cent on all Taxable property within their respective Counties as will ^with the labour above required^ in their opinion be necessary to keep the roads in good repair through the year. And the Tax so assessed shall be Expended within the district where collected
Sec 2 It shall be the duty of the Clerks of the County Commissioners Courts of each of the Counties in this State, so soon as the Tax is assessed as provided in the first section of this act, to furnish the supervisors of each of the Road district within their respective Counties, with a list of the Tax due from each individual living within his Road district, and also the Tax due on the property of all Non Residents and all Taxes so assessed may be discharged in labour at the rate of one dollar

per day, for each able bodied man, and in that same rates for all other kinds of work done on Roads in discharge of the aforesaid Tax, The Supervisors to decide the value of labour, not specifically defind [ agreeable ?] And in all other respects, [than?] herein before provided, the County Commissioners Courts & Supervisors shall be governed by the Laws now in force in Relation to Public Roads and all laws inconsistent with the provisions of this act are hereby repealed

1Robert Smith introduced HB 160 in the House of Representatives on January 20, 1840. The House referred the bill to a select committee. The select committee reported back the bill on February 3 with a substitute, but the session ended before the House could take any further action.
