Sec [Section]1 Be it enacted by the people of the state of Illinois, represented in the General Assembly, That so much of the work on the Great Wabash river as has been let and is now under contract under a compact between the States of Indiana and Illinois, shall be prosecuted in the manner prescribed by the terms of said compact and the contracts made pursuant thereto, to final completion.
Sec. 2. A special Commissioner shall be elected by the present General Assembly to superintend said work on behalf of this state who shall hold his office until the first day of January 1841, and until his successor is shall be elected and qualified, who shall perform the same duties in relation to said work which by law were heretofore required to be done by the Commissioner of the board of Public Works for the fourth Judicial Circuit, under an act entitled “an act to establish and maintain a general system of Internal Improvement;” and said Commissioner shall be paid the sum of dollars per day, when necessarily employed, as a compensation for his services.
Sec. 3. It shall be the duty of such Commissioner to confer with the Commissioner or authorized agent of the State of Indiana, and to adopt such measures as shall be best calculated to expedite the construction and early completion of said work.
Sec. 4. The Commissioner aforesaid shall have power to draw upon the fund Commissioners or other person or persons appointed and authorized to hold the funds belonging to, and provided for, the purposes of Internal Improvement, for such sum or

sums of money which shall be equal to that furnished by the State of Indiana for the construction of said work aforesaid, or shall hereafter be furnished and paid by the said State of Indiana, not exceeding the amount originally appropriated for said work by the act aforesaid.
Sec. 5. The said Commissioner aforesaid shall execute to the Governor of the State of Illinois a bond with good and sufficient security to be approved by the secretary of State in the sum of twenty thousand dollars, conditioned for the faithful performance of the duties enjoined on him by the provisions of this act.
Sec. 6. This act to be in force from and after the passage thereof.

1Joseph G. Bowman introduced HB 167 in the House of Representatives on January 20, 1840. The House referred the bill to a select committee. The select committee reported back the bill on January 28 with an amendment, in which House concurred. On January 30, representatives offered amendments, and the House referred the bill and proposed amendments to another select committee. The select committee reported back the bill on January 31 with an amendment, in which the House concurred. The House engrossed the bill, but did not read it a third time.
