Be it enacted by the People of the state of Illinois, represented in the General Assembly.
That, in all cases arising under the twenty ninth section of the act entitled “An
Act to establish and maintain a general system of Internal Improvement” approved 27
Feby[February] 1837, or ^under^ any act subsequent laws, amendatory of said section, wherein appeals have been taken from
the assessment of damages by the appraisers therein provided for, if upon the trial
of such appeals in the Circuit Court, any such case shall have been dismissed, or
the plaintiff ^or plaintiffs^ therein shall have been instructed, by reason of any informality in the proceedings,
or of any defect in the title papers of such plaintiff ^ or pltffs[plaintiffs] ^ or the said case shall have been disposed of in any other manner than by the verdict
of a jury of in the said circuit court, such pltff[plaintiff] or pltffs are hereby authorised and permitted to reinstate such case upon the docket of said circuit court, and to
proceed therein as ^is^
provided in the said laws, as if such case had never before been tried in the said
circuit court: Provided that such case be re-instated on said docket, & such case proceeded in by such pltff or pltffs, within one year from the passage of this act: And Provided further, that if there existed any defect in the title papers of such [...?] pltff or pltffs, at the time of such proceedings in the Circuit Court, or at the time of the assessment
of the damages therein, and such defects shall have been since supplied, the case
shall proceed, as if the title papers had been originally complete.
