Whereas by an order of the Board of Public works the Northern cross rail road at Jacksonville has been turned out of a direct line and made to pass through the Public square of said Town thereby adding greatly to the cost of the road and injuring its utility. And Whereas the County Commissioners of Morgan County, in the behalf of the people of said County have protested against the passage of said road through the Public square of said Town
Therefore
Sec 1 Be it enacted by the people of the State of Illinois represented in the General Assembly, That the Northern cross rail road shall be constructed (via) the Town of Jacksonville so as to run down and upon North Street passing by the Jail
Sec 2. That the superstructure of wood and iron now partially laid upon the diverging line through the public square be removed by the contractors and placed upon said line and if any money has been paid for the right of way upon the diverging line through the square that the Commissioners of Public works or other officers having charge of said road may compromise with the owners of the land and release the right of way thus acquired, and in all cases where the right of way has

been acquired upon said diverging line whether by purchase or by donation, said officer shall have power to surrender the same to the owners of the land over which the rights have been thus acquired upon such terms as may be agreed upon by the owners of said land and the officer having charge of said road Provided that in making the change of the road named in this act it shall not be lawful to charge the state any sum for the right of way by reason of such removeal.

1On December 30, 1839, William Weatherford introduced SB 45 in the Senate, and the Senate referred the bill to the Committee on Internal Improvements. On January 22, 1840, the committee reported the bill with several amendments, and the Senate concurred in those amendments. On January 23, the Senate voted against passage of the bill. On January 24, the Senate agreed to reconsider the bill and then laid the bill on the table. On January 27, the Senate passed the bill. On January 28, the House of Representatives passed the bill.
