Sec.[Section] 1. Be it enacted by the People of the State of Illinois represented in the General Assembly. That when any mortgagee shall die leaving a mortgage on record without an entry of satisfaction thereon, that it shall be lawful for the Executor or Administrator of said mortgagee (when ever the moneys or property due on said mortgage shall be paid up to them, and that there is nothing due on the same) to enter on the record where said mortgage is recorded satisfaction of the same in as full and ample a manner as ought to be done by the original mortgagee. And said release shall have the same effect as though it had been made by the mortgagee
Sec. 2 This act shall take effect and be in force from and after its passage.

1Jonas Rawalt introduced HB 36 in the House of Representatives on December 19, 1839. The House referred the bill to the Committee on the Judiciary. The Committee on the Judiciary reported back the bill on December 27 with amendments, in which the House concurred after further amendment. The House passed the bill as amended on January 2, 1840. On January 27, the Senate referred the bill to the Committee on the Judiciary. The Committee on the Judiciary reported back the bill on January 30, recommending its rejection, and the Senate tabled it.
