An ACT to amend an act, entitled “An act to incorporate the town of Kaskaskia,” approved, January 6, 1818.
1Powers of president.
Sec.[Section] 1. Be it enacted by the People of the State of Illinois, represented in the General Assembly, That the president of the board of trustees of the town of Kaskaskia for the time being, shall have and exercise the authority of a justice of the peace within the corporate
limits of the said town of Kaskaskia, and shall have power to administer oaths, issue writs and process under the seal
of said corporation, and he, or any justice of the peace, may try and determine all causes of action
arising under this act, or the act to which this is an amendment, or any of the ordinances
of the corporation, for fines, penalties, or otherwise. He shall have concurrent jurisdiction with justices
of the peace in all civil and criminal cases within the limits of said corporation, and shall receive the same fees and compensation allowed to justices of the peace
for similar services. He shall also have power to take acknowledgments of deeds, mortgages,
and all other instruments of writing as justices of the peace have, and certify the
same under the seal of the corporation of said town.

Sec. 2. That the trustees of the town of Kaskaskia, and their successors in office, shall have power to make regulations to secure the general health of the inhabitants;
to prevent and

remove nuisances; to suppress all riots and disorderly conduct; to impose and collect fines, for all
such offences; to establish night watches; to put up lamps in the streets, and provide
for lighting the same; to open, widen, and keep in repair the streets, avenues, lanes,
alleys, drains and sewers, and to keep the same clean, and free from incumbrances;
to erect pumps and sink wells in the streets, and keep the same in repair; to build
and repair bridges within the limits of the corporation. To subscribe, take and hold stock in the Kaskaskia bridge company, and when necessary, dispose of the same; to establish, license, and regulate markets;
to establish and regulate a fire department, and to provide for the prevention and
extinguishment (of) fires; to regulate the storage of gunpowder, and other combustible
materials; to prevent the shooting of fire arms; to prohibit and punish the keeping
of gaming houses and other disorderly houses.

Sec. 3. The trustees of said town are hereby authorized and empowered to make, have, and use a common seal, the same to alter and amend at pleasure; to establish not exceeding three elementary
schools, wherein reading, writing, arithmetic, geography, and other branches of education
may be taught, and for this purpose the trustees of said town are hereby authorized to purchase lots and erect suitable buildings in such parts
of the town as may be deemed by them the most convenient and beneficial to the citizens thereof;
and the said trustees are hereby empowered by ordinance to direct whatever may be
necessary to be done for successfully carrying into operation the provisions of this
section.
Qualification for trustee or voter
Sec. 4. No person shall be eligible as trustee, or qualified to vote for trustees unless he shall be a free white male inhabitant
in said town of twenty-one years of age or upwards, and shall have resided sixty days next preceding
such election within the corporate limits of said town, and all persons thus qualified shall be eligible as trustees, and to vote for trustees,
and to vote at all town meetings.
Notices, how made public
Sec. 5. All notices posted up on the door of the court house in the town of Kaskaskia relative to this act, or to the act to which this is an amendment shall answer every purpose and be equally
valid and binding in law as if the same should be printed in a public newspaper printed
in the said town of Kaskaskia, any thing in the act to which this is an amendment to the contrary notwithstanding.
Plat of town to be recorded
Sec. 6. That the trustees of said town, be, and they are hereby authorized to cause to be made a plat of said town, and have the same recorded in the office of the recorder of Randolph county, with like effect as the plat of other towns in this State are recorded, which plat shall be taken in all courts of this State to be evidence of the location and position of the streets, alleys, blocks, squares,
and lots, in said town, unless the contrary shall be shown by competent and conclusive evidence.

Sec. 7. This act is hereby declared to be a public act, and shall take effect and be in
force from and after its passage.2

1Jacob Feaman introduced SB 54 to the Senate on December 17, 1840. The Senate passed the bill on December 28. The House of Representatives referred it to the Committee on Banks and others Corporations on January 21, 1841.
The committee reported back on February 5 and recommended an amendment, to which the
House concurred. The House passed the bill on February 12. The Senate passed the amended
bill on February 19, The nest day, the Council of Revision approved the bill and the act became law.
