Concerning
Roads.
1Sec.[Section] 1. Be it enacted by the People of the State of Illinois represented in the General Assembly, That hereafter all persons who are required by the present laws to work upon the
roads, shall work Two days each in every year in the manner and under the regulations
of the present, existing statutes upon the subject of roads.
Sec. 2. The county Commissioners of each county at their first regular term of court after the first day of March of each year shall levy a road tax upon all the taxable
property of the County not exceeding five Cents on every one hundred dollars in the
same way and manner that County taxes are levied for other purposes; and the said
tax shall be collected as taxes for other purposes are Collected; and when Collected
the same shall be paid into the County Treasury of the People of the County in all
cases.
Sec. 3. It shall be the duty of the collectors of taxes to furnish to the Clerks of the
County Commissioners Court of each County, a statement of the amount of road tax Collected in each road district
of the County at or before the time when said Collectors are required to pay over
the County revenue to the Treasurer, and the clerk of said County shall furnish each
supervisor of the roads within the County a statement of said amount of taxes Collected.
Sec. 4. It shall be the duty of the supervisors to procure materials, and employ laborers
to work the roads when necessary, in the manner no^w^ authorized by law, and to draw upon the Treasurer of the County for the money to
pay for said

materials and labor, and to furnish said treasurer sworn and proven Vouchers for the
amount so expended, which said amount shall in no instance exceed the amount of road2 taxes Collected in the said respective road districts.
Sec. 5. The said Treasurer of the County shall make a report to the County Commissioners Court whenever required by said Court, of the amount of road tax paid out by him, and to what districts the same has been
applied, and upon what Vouchers the same has been drawn.
Sec. 6. The Collectors shall Collect said road tax in money in all instances, and pay
the same over to the Treasurers in money, and said Treasurers shall pay out and disburse
the same in money.
Sec 7. All laws and parts of laws inconsistent with this act is hereby repealed; and
this act shall take effect from and after its passage3

1Joseph W. Ormsbee introduced HB 53 in the House of Representatives on December 24, 1840. On December 30, the House referred the bill to the Committee
on the Judiciary. The Committee on the Judiciary reported back the bill on January
4, 1841, recommending its reference to the Committee on State Roads, and the House
referred the bill to said committee. The Committee on State Roads did not report
back the bill.

in some fashion provisions of HB 53.
