An ACT to re-locate a part of the State road from Carmi to Mt. Carmel.

Com’rs[commissioners] to locate road.
Sec. 1. Be it enacted by the People of the State of Illinois, represented in the General Assembly, That Powhatan H. Bagwell and James Kennedy, of Wabash county, and William H. Coles, of Edwards county, be and they are hereby appointed commissioners to review and relocate so much of the State road, leading from Carmi to Mt. Carmel, as lies between Grayville, in White county, and the bridge across Bon Pas river.

To be sworn.
Report & plat of road.
Sec. 2 The said commissioners, or a majority of them, shall meet at Grayville, on the first Monday in June next, or some day thereafter; and after being duly sworn, by some justice of the peace of White county, faithfully to locate said road, taking into consideration the most eligible route and the most eligible place for crossing Mud creek, between the points specified in the first section of this act, shall proceed to make said location, marking the trees through the timber, and return a survey and plat thereof to the county commissioners’ court of Edwards county, which shall be recorded by the clerk thereof.
Road vacated
Sec. 3. After said re-location shall have been made, and the plat and survey thereof returned, the county commissioners’ court of Edwards county are hereby required forthwith to

cause the said road, thus located, to be opened and kept in repair as other State roads are required to be; and the road, as now located, shall be vacated.

1On February 9, 1841, Nelson Nunnally introduced SB 166 in the Senate. On February 10, the Senate passed the bill without amendment. On February 27, the House too passed the bill without amendment by a vote of 36 yeas to 27 nays, with Lincoln voting yea. That same day, Council of Revision approved the bill, and the act became law.
