Sec[Section] 1 Be it enacted by the people of the State of Illinois Represented in the General Assembly, That Joseph Fowler and Henry Fuller, of Coles County, ^4^John Pervis of Shelby County, and Christopher B Stafford of Sangamon County be and they are hereby appointed Commissioners to view, mark, Survey, and relocate a State road from Charlestown to Springfield; commencing at or near where the state road from Charleston to Shelbyville leaves the Kickapoo timber, thenc in a direction to the nearest timber on the Okaw, or Kaskaskia river, and from thence in the most practicable direction, to the most suitable place, or point, to intersect the state road, from Springfield to Shelbyville
Sec 2. The said Commissioners, or a majority of them shall meet at the house of Joseph Vandever, in the County of Coles, on the first day of May next, or within three months thereafter, and being first duly sworn before some Justice of the Peace, faithfully to discharge the duties required of them by this act, shall proceed to view, mark, survey, and relocate, the before mentioned state road, and as soon as practicable thereafter the said Commissioners, shall make a report of their proceedings to the County Commissioners Court, of each of the Counties through which said roads shall pass, which report shall be filed with the Clerks of said Courts, and the said road thus laid out and relocated shall be and is hereby declared a public state road, and shall be opened and kept in repair as other state Roads, and such part or parts of the former state road, as may be superceded by the relocation authorised by this act are hereby vacated
Sec 3 Said Commissioners shall be allowed a reasonable Compensation for their services, to be paid by the Counties through which said road shall pass, in proportion to the extent of said road in each County.

1Byrd Monroe introduced SB 4 in the Senate on December 10, 1838. On January 21, 1839, the Senate passed the bill. On January 29, the House of Representatives referred the bill to a select committee. The select committee reported back the bill on February 5 with an amendment, and the House referred the bill and proposed amendment to the Committee on State Roads. The Committee on State Roads did not report back the bill.
