Sec[Section] 1st Be it enacted by the people of the state of Illinois represented in the General Assembly that the Governor of the state of Illinois be and he is hereby authorised and required to make sale of a sufficient number of bonds heretofore authorised to be issued by him for Canal purposes to raise the amount of money now due and unpaid
including interest on a certain loan from the fund commissioners to the “Illinois and Michigan Canal fund” made under and by virtue of an act of the legislature of Illinois approved January 21st 1839 entitled “an act authorising a certain loan for canal purposes” which said money was under said act received by the Governor under this pledge to reimburse the same2

1William J. Gatewood introduced SB 29 in the Senate on December 9, 1840. On December 10, the Senate struck out the words “under this
pledge to reimburse the same.” The Senate passed the bill as amended. On December
11, the House of Representatives referred the bill to the Committee on Internal Improvements. The Committee on Internal
Improvements reported back the bill on December 15 with an amendment, in which the
House concurred. The House referred the bill and proposed amendment to the Committee
on Canals and Canal Lands, of which Abraham Lincoln was a member. The Committee on Canals and Canal Lands reported back the bill on
January 14, 1841, with an amendment to the proposed amendment, in which the House
concurred by a vote of 42 yeas to 39 nays, with Lincoln not voting. On January 18,
the House considered several proposed amendments, and on January 19 the House tabled
the bill and proposed amendments by a vote 42 yeas to 41 nays, with Lincoln not voting.

The act passed on January 21, 1839, authorized the fund commissioners of the state to loan $300,000 to the Illinois and Michigan Canal Fund. Said loan carried six percent interest, and the loan plus interest was to
be repaid by June 1, 1840.
