Unless in his opinion the value of the Ground has not been
bid, in which case he shall have the Ground laid off into Lots and Streets, in such manner
as will insure the highest and best price to the State; and proceed to sell the same at Auction at such time, as he in his Judgment may
think will best advance the interest of the State
