^ unable, from sickness or any other unavoidable casulty, to discharge the duties of Assesser, he shall forthwith tender his resignation to the County Commissioners Court, which shall fully discharge the said Assessor from the penalty aforesaid, and the
County Commissioners Court shall in all such cases fill said vacancy
