Fleming R. Payne studied medicine in Louisville, Kentucky before settling in Marshall, Illinois, where he practiced as a physician. He married twice, first to Sarah Shaw who died in 1852, and second to Mary E. Alexander Chestnut, who he wed in 1854. His first marriage produced two children and his second marriage, four. In 1860, Payne owned over $14,000 in real and personal property. Payne was active in politics, initially as a Whig and later as a Republican.
