Be it enacted by the people of the State of Illinois Represented in the General assembly:
Sec[Section] 1st That whenever in the opinion of the County Commissioners Court of St Clair County the Public interest or convenience require that ^part^ of the State Road leading from Vincennes to St Louis that extends from Cahokia creek to the Mississippi River to be opened the Said Court Shall give notice to the proprietors of Said Land over which Said Road proposed to
be opened Shall run and it Shall be the duty of Said court and proprietors each to choose one disinterested person, and the persons thus chosen,
Shall choose2 a third which three persons thus chosen Shall determine the width, the aforesaid
road Shall be opened, and assess the damages the aforesaid proprietors of Said land
will Sustain, and report the Same to the County Commissioners Court of the aforesaid County
Sec 2 when in the opinion of the aforesaid Court the public interest or convenience require it Shall be the duty of Said Court upon appli-

cation, according to Law to grant a license for a Steam or Horse ferry at the termination
of said Road, and they are hereby authorized to demand for Said license any Sum not
exceeding three hundred dollars a year to be appropriated in the improvement of the
Roads leading to Said Ferry, within 7 miles thereof
Sec 3 Said Court Shall have authority to regulate the rates of Said Ferry and impose Such restrictions
and limitations as are now provided for by an act to provide for the establishment
of Ferries, toll Bridges, and Turnpikes Roads, approved Feb[February] 12. 1827, This act to be in force from and after its Passage Provided that the present proprietors of the Soil Shall have the preference when Said court Shall think proper to establish an additional Ferry

1In response to a petition that was referred to the Committee on Petitions, John T. Stuart from the Committee on Petitions introduced HB 44 in the House of Representatives
on December 19, 1834. On January 8, 1835, the House referred the bill to a select
committee., which reported back the bill on January 17 with amendments. On January
27, the House referred it to a select committee, which reported back the bill on January
31 with an amendment. The House concurred in the amendment and on February 5, they
passed the bill. On February 9, the Senate tabled the bill and a proposed amendment to it. On February 12, the Senate voted
against striking out the proposed amendment by a vote of 10 ayes to 11 nays. The
Senate then indefinitely postponed further consideration of the bill.
