AN ACT to locate a State road from Shawneetown in Gallatin county, to Golconda in Pope county.

Commissioners appointed
Sec. 1. Be it enacted by the people of the State of Illinois represented in the General Assembly, That John Ellis and Robert Thompson of the county of Gallatin, and Daniel Vineyard and John Howard2 of the county of Pope be, and they are hereby appointed commissioners to view, survey, and locate a state road from Shawneetown in Gallatin county, to Golconda in Pope county.
When and where to meet.
To be sworn.
Their duties.
Sec. 2. The said commissioners or a majority of them, shall meet at the house of Isaiah L. Potts in Gallatin county, on the second Monday in May next, or within a convenient time thereafter; who after being duly sworn before some justice of the peace faithfully to discharge the duties hereby enjoined on them by the provisions of this act, shall proceed to view, survey, and locate said road, taking into consideration the local situation of the country through which the road shall pass, and the economy of a judicious adoption of the direct mail between

said towns, selecting at all times the most eligible and advantageous ground for the location of said road, and the said commissioners shall, on or before the first Monday of September next, make or cause to be made, a true chart or map of said road signed by them respectively, to be filed in the offices of the clerks of the county commissioners courts of the several counties through which the said road shall pass, or be located.
To be deemed a state road.
Sec. 3. Said road when laid out as aforesaid, shall be deemed and considered a state road,3 and the county commissioners courts of the counties through which the said road may pass, shall appoint supervisors for said road, and cause the same to be opened a convenient width and to be worked and kept in good repair.
Compensation.
Sec. 4. The commissioners appointed under the provisions of this act, shall receive a just and fair compensation for the time they are necessarily employed in the survey and establishment of said road, each county paying for the time necessarily employed therein.

1On February 2, 1837, John A. McClernand introduced HB 162 in the House of Representatives. On February 8, the House passed the bill. On February 21, the Senate amended the bill by filling in the blank in the first section with the name “John Howard.” On February 22, the Senate passed the bill as amended. On February 27, the House concurred in the Senate amendment. On February 28, the Council of Revision approved the bill, and the act became law.

3State roads were those public roads established or designated by the General Assembly and usually crossed county lines. Only the General Assembly could establish, alter, or abandon state roads, until 1840 and 1841, when the General Assembly gave counties the authority to alter or to abandon state roads upon petition by a majority of voters in the area of the change.
