Sec[Section] 1 Be it enacted by the people of the State of Illinois represented in the General Assembly; That all deeds, mortgages, transfers[,] conveyances, and all common assureances of any kind whatever which have been or may hereafter be executed and acknowledged or proven according to and in conformity with the Laws of the State or Territory in which the same was or may be made for lands[,] tenaments[,] or hereditaments, situated in this State, shall be admitted to record in this State, and shall operate from the date of the recording thereof, as though the same had been executed and acknowledged or proven according to the Laws of this State.
Sec. 2. That any of the instruments of writing described in the foregoing section, relating to lands, tenaments, or hereditaments, situated in this State which have been executed and acknowledged or proven in conformity with the laws of the state or Territory where the same was executed, and have been admitted to record in this State, shall be deemed and taken as having been rightfully recorded and shall operate from the date of the recording thereof as ^though^ the same had been admitted to record according to the Laws of this state

1John Hamlin introduced SB 108 in the Senate on January 19, 1839. The Senate passed the bill on February 4. On February 5, the House of Representatives referred the bill to the Committee on the Judiciary. The Committee on the Judiciary reported back the bill on February 28, recommending its rejection. The House refused to order the bill for a third reading.
